Agreement Overview
Welcome to Intonality. These Terms of Service govern your use of our music campaign platform. By accessing or using our service, you agree to be bound by these terms.
We've designed these terms to be clear and fair, protecting both your rights as a user and our ability to run a platform that serves artists and curators properly.
User Accounts & Registration
Account Creation
- Must be 13 or older to create an account
- Provide accurate and complete information
- One account per person
- Keep login credentials secure
Account Responsibility
- You are responsible for all activity on your account
- Notify us immediately of any security breach or unauthorised access
- Update your information when it changes
Service Description
What We Provide
- A platform for artists and managers to submit music to Spotify playlist curators
- Campaign management and tracking tools
- Curator application and review workflows
- Written feedback from human curators
Service Availability
- We strive for high availability but do not guarantee uninterrupted service
- Maintenance windows may cause brief downtime
- Service availability may vary by region
Artist Campaigns
When you submit a music campaign, you confirm that:
- You have the right to submit the track (you are the artist, manager, or authorised representative)
- The track information you provide is accurate
- You understand that curator decisions are independent - we do not guarantee placements
- Campaign budgets are non-refundable once processing has begun
Intellectual Property
Music Rights
- You retain all rights to music you submit
- We do not claim ownership of submitted content
- By submitting, you grant us permission to share your track with curators for review purposes
- We do not host or redistribute your music publicly
Our Content
- Platform design, features, and curation processes are our intellectual property
- Do not reproduce or redistribute our platform content without permission
Prohibited Activities
The following are strictly prohibited:
- Harassment or abuse of curators or staff
- Submitting music to which you do not have rights
- Attempting to manipulate or game our curator network
- Creating fake accounts or submitting fraudulent campaigns
- Attempting to breach or circumvent our security measures
Violations may result in warning, suspension, or permanent ban. We cooperate with legal authorities when necessary.
Payment
Campaign budgets are processed via our payment provider. By paying for a campaign:
- You authorise the charge to your payment method
- You understand campaign budgets cover pitching services, not guaranteed placements
- Refunds are considered on a case-by-case basis at our discretion
Privacy & Data Protection
Your privacy matters to us. Our Privacy Policy explains in detail how we collect, use, and protect your personal data. By using our service, you agree to our data practices as outlined there.
Account Termination & Service Changes
We reserve the right to:
- Suspend or terminate accounts that violate these terms
- Modify or discontinue features of the service at any time
- Update these Terms of Service - we will notify you of material changes
You may close your account at any time by contacting us.
Disclaimers
The service is provided "as is" without warranty of any kind. We do not guarantee:
- Specific outcomes for music campaigns
- Uninterrupted or error-free service
- That our service meets every user's specific requirements
Our liability is limited to the amount you paid for the relevant campaign or service.
Curator Earnings & Self-Billing
Earnings Payouts
Curators who accumulate earnings through completed campaign reviews may request a withdrawal once a minimum threshold is reached. Payouts are processed manually and are subject to verification.
Self-Billing Agreement
By applying to become a curator and accepting these Terms, you agree to the following self-billing arrangement:
- Invoice issuance: Intonality (operated by Intonality LLC) will issue payment invoices on your behalf as the supplier. You accept each invoice issued as if you had issued it yourself.
- Invoice accuracy: You are responsible for reviewing each self-billing invoice issued to you and notifying us immediately of any discrepancies.
- Tax obligations: You are solely responsible for any tax, VAT, or other fiscal obligations arising from payments received. Intonality SIA will not withhold taxes on your behalf unless required by law.
- EU curators: Payments to curators established within the European Union are subject to the VAT reverse charge mechanism under Article 44 and Article 196 of Council Directive 2006/112/EC. You are responsible for accounting for VAT in your own jurisdiction.
- Non-EU curators: For curators outside the European Union, VAT does not apply to these payments.
Each payout invoice will include the notation "Self-billing invoice issued by the platform on behalf of the supplier" and the applicable VAT note for your region.
